INDIA bloc MPs submit letter to LS Speaker to move impeachment motion against Justice Swaminathan.
They sought to move a motion for his removal under Article 217, read with Article 124, of the Constitution of India.
They stated that the conduct of Justice Swaminathan raised serious questions regarding impartiality, transparency, and the secular functioning of the judiciary.
The MPs submitted copies of letters written by members of the Rajya Sabha and the Lok Sabha to the President of India and the Chief Justice of the Supreme Court.
One hundred members of the Lok Sabha or 50 members of the Rajya Sabha have to sign an impeachment motion against a High Court judge.
If the motion is accepted, a three-member committee will investigate it.
Thereafter, both Houses must pass the motion by a special majority (two-thirds present and voting, plus absolute majority of total membership).
Finally, the President will issue the removal order.
However, no judge has been successfully impeached in India.
