- Supreme Court has ruled that minors can challenge any property sale or transfer done by their parents or guardians without a lawsuit, after turning 18.
- The court also said adults can cancel such transfers by taking clear actions, like selling or transferring the property themselves.
- The verdict came in K S Shivappa vs Smt K Neelamma case.
- As per the Hindu Minority and Guardianship Act, 1956, Natural guardians must act for the minor’s benefit.
- Guardians cannot sell, mortgage, or lease a minor’s immovable property without court permission.
- Limitation Act, 1963 also grants a person 3 years after attaining majority to challenge or set aside such a property transfer.
- The ruling reaffirming the precedent set in Abdul Rahman v. Sukhdayal Singh Case, 1905.
