The Supreme Court of India delivered a split verdict on the constitutional validity of Section 17A of the Prevention of Corruption Act, 1988.
Section 17A was introduced by the Prevention of Corruption (Amendment) Act, 2018.
It requires prior approval of the competent authority before conducting any enquiry or investigation against a public servant for decisions taken in the discharge of official duties.
The provision was challenged by the Centre for Public Interest Litigation (CPIL).
The Supreme Court Bench expressed divergent judicial views on the validity of Section 17A.
