Tamil Nadu Assembly Speaker disqualified 18 dissident ruling party’s MLAs, owing allegiance to sidelined party leader.
Since the Speaker disqualified them under the Members of the Tamil Nadu Legislative Assembly (Disqualification on Ground of Defection) Rules, 1986, the 18 ceased to be legislators.
MLAs have “incurred disqualification” under Article 191 (2) of the Tenth Schedule of constitution.
Article 191(2) - A person shall be disqualified for being a member of the Legislative Assembly or Legislative Council of a State if he is so disqualified under the Tenth Schedule.
