- Both houses of Parliament have passed the Muslim Women (Protection of Rights on Marriage) Bill 2019.
- Lok sabha passed the bill on 25-07-2019 and the Rajya sabha passed the bill on 30-07-2019.
- The Bill would help in protecting the rights of married Muslim women and prevent divorce by practice of ‘Talaq-e-biddat’ by their husbands.
- It declares the practice of triple talaq, including in written or electronic form, as void and illegal.
- It makes this offence punishable with imprisonment up to three years and fine.
- The amount of any fine is at the discretion of the Magistrate hearing the case.
- It provides for payment of ‘subsistence allowance’ to married Muslim women and dependent children which is decided by the magistrate.
- The wife is entitled to seek custody of the minor children from the marriage.
- The offence is non-bailable. However, there is a provision that the magistrate hearing the case may grant bail to the accused.
