Constitutional Safeguards for Ladakh

  • The Centre has proposed a new Article 371(K) to provide constitutional safeguards and greater local autonomy to Ladakh.
  • The proposed provision may create a directly elected Union Territory-level governing body with legislative powers over land, culture and language, forests, environment and natural resources.
  • The proposed body may also have powers over subjects currently reserved for the Union Territory under Article 240 of the Constitution.
  • Article 240 gives the President of India power to make regulations for the peace, progress and good government of certain Union Territories.
  • Ladakh has sought additional executive, budgetary, planning and financial powers, including control over police and law and order.
  • The Centre has said further discussions will be held in October, when a draft of the proposed Article 371(K) is expected to be discussed.
